AUCTION TERMS & CONDITIONS

1. ACCEPTANCE OF TERMS
By registering for, bidding in, or otherwise participating in this auction, you (“Bidder”) expressly acknowledge and agree to be bound by all terms and conditions set forth herein. These Terms constitute a legally binding agreement between the Bidder and The Missing Piece LLC (“Seller”).
You must be at least 18 years old to register and bid. Using a false identity or another individual’s account is strictly prohibited and will result in permanent suspension or termination of bidding privileges. Seller reserves the right to verify bidder identity at any time.
Failure to read or understand these Terms does not relieve the Bidder of any obligations contained herein. If you do not agree to these Terms in their entirety, you are expressly prohibited from bidding.
2. AUCTION PROCESS & BIDDING PROCEDURES
All bids placed are binding offers to purchase. Once submitted, bids may not be retracted, modified, or canceled.
The auction may utilize a staggered closing and/or soft close format, whereby bids placed within the final moments of a lot’s closing will automatically extend the bidding period. This ensures a fair and competitive bidding environment.
The Missing Piece LLC and the Auctioneer reserve the absolute right to:
- Accept or reject any bid at their sole discretion
- Withdraw, modify, regroup, or combine lots
- Cancel, pause, or reschedule any auction or lot
- Resolve bidding disputes in a manner deemed appropriate
- Reopen bidding in the event of system error, dispute, or suspected fraudulent activity
In the event of a dispute, the decision of The Missing Piece LLC shall be final and binding.
3. BUYER’S PREMIUM & SALES TAX
A 10% Buyer’s Premium will be added to the final hammer price of each lot and forms part of the total purchase price.
A 5% Wisconsin Sales Tax will be applied to the entire transaction amount, including:
- The final bid price, and
- The Buyer’s Premium
Bidders claiming tax exemption must submit valid exemption documentation prior to the close of the auction. No refunds or adjustments will be made once invoices have been processed. It is the Bidder’s sole responsibility to ensure tax-exempt status is properly documented before bidding.
4. PAYMENT TERMS (STRICT ENFORCEMENT)
A valid credit card is required for registration and must remain on file throughout the auction. A $1 pre-authorization will be placed on each bidder's payment method on their first bid or purchase in this sale to verify the card is valid. The hold is released immediately and only occurs once per sale.
Automatic Payment Authorization
By registering and placing a bid, the Bidder authorizes The Missing Piece LLC to charge the credit card on file for the full invoice amount without additional notice.
- All invoices will be processed and charged within 24 hours of auction conclusion
- This policy is strictly enforced
Alternative Payment Methods
Alternative payment arrangements (cash, certified funds, etc.) must be:
- Approved in writing in advance, and
- Confirmed prior to auction closing
- Completed at the time of pickup
No business or personal checks over $1,000 will be accepted.
Failure to pre-arrange payment will result in automatic credit card processing.
High-Value Transactions
For invoices exceeding $1,000, The Missing Piece LLC reserves the right to:
- Require ACH or wire transfer (funds must be cleared prior to pickup)
- Charge a deposit to the card on file
- Withhold release of items until secured funds are confirmed
NO ITEMS WILL BE RELEASED WITHOUT CLEARED PAYMENT
5. DECLINED PAYMENTS & NON-PAYMENT
In the event a payment method is declined:
- A $25 processing fee may be applied per attempt
- The Bidder will have 24 hours to resolve the issue from the first failed attempt
Failure to remit payment within this timeframe constitutes default.
Upon default:
- The Seller may cancel the transaction
- The item(s) may be resold
- The winning Bidder will be held financially responsible for:
- Any deficiency between resale and original bid
- Administrative costs
- Collection fees
- Legal expenses
The Seller reserves the right to report non-paying bidders to third-party auction platforms and collections agencies.
6. NO CHARGEBACK POLICY
All sales are final. By participating in this auction, the Bidder expressly agrees not to initiate any credit card chargeback or payment reversal.
Any attempt to dispute a valid charge:
- Will be considered a breach of contract
- Does not release the Bidder from payment obligations
The Missing Piece LLC reserves the right to:
- Pursue legal remedies
- Recover all associated costs, including attorney fees
- Submit these Terms as evidence of agreement
7. CONDITION OF ITEMS / DISCLAIMER OF WARRANTIES
All items are sold strictly “AS IS, WHERE IS, WITH ALL FAULTS.”
No guarantees or warranties of any kind are made, expressed or implied, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Authenticity
- Condition
- Completeness
Descriptions, photographs, and representations are provided as a courtesy and are not guaranteed to be accurate. Variations may occur due to lighting, photography, or human error.
The Bidder assumes full responsibility for determining the condition and value of items prior to bidding.
8. PREVIEW / INSPECTION POLICY
Inspection of items is strongly encouraged.
- All previews are BY APPOINTMENT ONLY
- Only ONE additional guest per appointment is permitted
- Bidders must call to schedule a designated time slot
- No walk-ins are permitted
- Preview timeslots are strictly limited and enforced
Preview Dates: 4/25/26 – 4/26/26
Failure to inspect an item shall not constitute grounds for cancellation, refund, or dispute.
9. PICKUP & REMOVAL
All pickups are strictly BY APPOINTMENT ONLY. No walk-up or unscheduled pickups will be permitted.
No alternative pickup times will be offered outside of scheduled availability. A scheduling link will be provided following the auction.
Pickup Requirements:
- Only ONE invoice per appointment
- A valid government-issued photo ID is required
- A copy of your PAID invoice must be presented
- Have your vehicles prepared to load your purchases
- Buyers must bring adequate:
- Labor
- Tools
- Packing materials
If items are being picked up by a third party on your behalf, you must notify The Missing Piece LLC in advance. The authorized party must present a copy of your paid invoice and comply with all pickup procedures. Failure to provide proper notice may result in refusal of item release.
The Missing Piece LLC does not provide packing services; all packing arrangements must be made directly with your selected transport or shipping provider.
Pickup Dates: 5/1/26 – 5/2/26
Failure to adhere to scheduled pickup procedures may result in delays or refusal of service.
10. FAILURE TO PICK UP / ABANDONED PROPERTY
Any item not removed within the designated pickup window will be deemed abandoned property.
The Missing Piece LLC reserves the right to:
- Resell the item
- Dispose of the item
- Retain all payments made
Additional charges may apply, including:
- Storage fees
- Handling fees
- Disposal costs
No refunds will be issued under any circumstances.
11. SHIPPING TERMS & CONDITIONS
Shipping is available only on designated items marked “Shipping Available.”
Shipping will only be made to the billing address associated with the card on file. No changes to the shipping address will be permitted without prior written authorization and verification.
In certain circumstances, items not designated as “Shipping Available” may qualify for alternative shipping arrangements. Requests must be submitted prior to auction close and require express written approval.

Failure to do so will result in items being designated as pickup only.
Shipping Costs & Handling
Shipping services are provided as a convenience and are not included in the purchase price. All shipping-related expenses are the sole responsibility of the Buyer and may vary significantly depending on item size, weight, fragility, and destination.
Shipping charges include, but are not limited to:
- Packing and shipping materials
- Labor for handling, packing, and processing
- Carrier charges and transportation fees
The Missing Piece LLC does not provide guaranteed shipping estimates. Any estimates are informal and subject to change. By requesting shipping, the Buyer agrees to accept all associated charges.
All shipping and handling charges will be billed to the card on file. A minimum $10 handling fee applies.
No adjustments, credits, or disputes regarding shipping costs will be accepted once items have been packed and/or shipped.
Shipping Liability
The Missing Piece LLC is not responsible for:
- Carrier delays
- Lost packages
- Damage incurred during transit
All shipping claims must be filed directly with the carrier.
12. REMOVAL LIABILITY & EQUIPMENT
Buyers are solely responsible for the safe, timely, and proper removal of all purchased items, including providing all necessary labor, tools, and equipment.
As a convenience, The Missing Piece LLC will coordinate the removal of items from the home and stage them in a designated pickup area according to scheduled appointments.
Loading assistance may be provided when available; however, such assistance is not guaranteed and is provided strictly as a courtesy.
Under no circumstances shall The Missing Piece LLC or its contractors be held liable for any injury, loss, or damage, including but not limited to damage to purchased items, vehicles, trailers, equipment, or personal property, arising out of or related to the removal, loading, or transportation process.
All assistance is performed at the Buyer’s sole risk.
13. TITLE & RISK OF LOSS
Ownership and risk of loss transfer immediately to the Bidder upon being declared the winning bidder.
The Seller is not responsible for items after the conclusion of the auction, regardless of possession status.
14. DEFAULT & ACCOUNT TERMINATION
Failure to comply with these Terms may result in:
- Immediate account suspension or permanent ban
- Forfeiture of bidding privileges
The Seller reserves all rights to pursue damages and enforce compliance.
15. FRAUD & ACCOUNT SECURITY
Bidders are responsible for all activity conducted under their account.
Any fraudulent activity will result in:
- Immediate termination
- Legal action where applicable
16. TECHNOLOGY DISCLAIMER
The Missing Piece LLC is not responsible for:
- Website outages
- Bidding delays
- Internet connectivity issues
- Missed bids for any reason
17. LIMITATION OF LIABILITY
In all circumstances, the maximum liability of The Missing Piece LLC shall be limited to the purchase price paid for the item.
18. GOVERNING LAW
These Terms shall be governed by the laws of the State of Wisconsin.
All disputes shall be resolved in the appropriate court within the jurisdiction of the Seller.
19. ON-SITE LIABILITY WAIVER
By attending preview or pickup, individuals acknowledge and accept all risks associated with entering the premises.
Assumption of Risk
Auction locations may contain:
- Uneven surfaces
- Heavy objects
- Environmental hazards
Entry is at the individual’s sole risk.
Release of Liability
All attendees agree to release and hold harmless:
- The Missing Piece LLC
- Greg Willett
- Property owners
From any claims involving:
- Injury
- Loss
- Property damage
Contractors & Representatives
Any third-party individuals (movers, contractors, etc.) are deemed agents of the Buyer. The Buyer assumes full responsibility for their actions.
Property Damage Responsibility
The Buyer agrees to pay for any damage caused to property during removal. Charges may be applied directly to the card on file.
20. CONSIGNOR PROTECTION TERMS
Agency Relationship
The Missing Piece LLC acts solely as an agent for the consignor.
Right to Protect Assets
The Seller reserves the right to:
- Withdraw items
- Set or enforce reserves
- Reject bids deemed insufficient
Default Protection
If a Buyer defaults, they are liable for all resulting damages, including resale losses and associated costs.
Hold Harmless Clause
The Buyer agrees to indemnify and hold harmless:
- The consignor
- The Missing Piece LLC
- Greg Willett (Auctioneer)
Against any claims related to the purchase or use of items.
Title Disclaimer
The Seller does not guarantee clear title unless explicitly stated. In the event of a verified title defect, remedies are limited strictly to refund of the purchase price.
